Welcome to Smartcent, a proprietary Software-as-a-Service (SaaS) platform operated by Smartcent Pty Ltd, dedicated to delivering high-quality tools for personal finance tracking, data consolidation, and financial information management. 


By accessing, browsing, or using any part of our services, features, content, or functionality (collectively, the “Services”), you acknowledge and agree to be legally bound by these Terms and Conditions (“Terms”). These Terms are intended to establish a secure, transparent, and trustworthy framework governing your use of the Services. 

By creating an account, selecting “I Agree and Continue,” or otherwise accessing or using the Smartcent Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. You further consent to the collection, use, storage, and disclosure of your personal, financial, and sensitive information as described therein, including the secure sharing of such information with authorised third-party service providers, where required to provide the services and features you have chosen to use. You acknowledge that you may be redirected to third-party systems to complete your consent or authentication process, and that your use of those systems is governed by their respective terms and privacy policies. By proceeding, you confirm that your consent is informed, voluntary, and given in accordance with the Privacy Act 1988 (Cth) and all applicable laws, and you may withdraw such consent at any time by discontinuing use of the relevant Feature, including by deleting connected bank accounts, downgrading your subscription plan, or deleting your Smartcent account, which will revoke all associated consents. 


The Services are made available through our integrated platform, comprising the Smartcent application and the website located at smartcent.com.au (together, the “Platform”). Your continued use of the Platform constitutes your full acceptance of, and agreement to comply with, these Terms.

Definitions 


In these Terms unless the context otherwise requires, the following expressions shall have the meanings assigned below. Words importing the singular include the plural and vice versa; references to “including” mean “including without limitation”; and headings are for convenience only and do not affect interpretation. 

 

Account means the registered user profile created by you on the Platform, which enables access to the Services offered by Smartcent. 
 
Wallet Health Report means the optional service available on the Platform which enables users to obtain an indicative affordability report prepared by third-party.  


Applicable Law means all laws, regulations, rules, and codes of practice applicable in the Commonwealth of Australia, including the Privacy Act 1988 (Cth), Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), and any other statutory instrument or guidance issued by a competent authority having jurisdiction.

12.4.  Consumer Guarantees 
Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded or limited. To the extent that any statutory guarantee applies and cannot be excluded, Smartcent’s liability for breach of such guarantee is, to the 
fullest extent permitted by law, limited at our option to:

You acknowledge that Smartcent does not guarantee the accuracy, completeness, suitability, or availability of any information, report, or analysis generated through the Platform and that any reliance placed on such material is entirely at your own risk.
